TERMS & CONDITIONS OF CHARTER
Version 1.0 – Effective 19 July 2025

SCOPE OF THESE TERMS

These Terms & Conditions (“T&C”) govern every reservation, payment and voyage carried out through Vip Yacht Ibiza, whether the booking is completed:

  1. directly on this Website or its embedded WooCommerce / booking engine,

  2. by e-mail, telephone or instant-messaging with our staff, or

  3. on-site at Marina Botafoch (Ibiza).

By ticking the acceptance box during online checkout or by signing our charter agreement, you confirm that you have read, understood and accepted these T&C in their entirety. If you do not agree, please do not proceed with any booking or use of our services.

Each clause applies unless expressly overridden by a written addendum signed by both the Charterer and ARGIOD S.L.

1. DEFINITIONS

  • “Company” – ARGIOD S.L., trading as Vip Yacht Ibiza, its directors, employees, agents and authorised representatives.

  • “Charterer” / “Client” / “you” – the person or entity named on the booking confirmation and any guests they bring on board.

  • “Vessel” / “Yacht” / “ETERNA” – the 22 m Baia Italia 70 motor-yacht, commercially coded under the Spanish flag.

  • “Charter” – the hire of the Vessel (with crew) for the agreed period and price.

  • “Day Charter” – up to eight (8) consecutive hours within the same day.

  • “Overnight Charter” – one or more nights on board (max 8 guests).

  • “Crew” – the professional captain and stewardess (plus any additional crew) appointed by the Company.

  • “Extras” – optional services/equipment not in the base price (e.g. Seabob, jet-ski escort, chef, catering, premium beverages, drone).

  • “APA” – Advance Provisioning Allowance: a prepaid float, if requested, to cover variable costs (fuel, external moorings, catering, etc.).

  • “Force Majeure” – events beyond reasonable control (severe weather, natural disaster, war, strike, pandemic, unforeseen mechanical failure, port closure).

  • “Booking Engine” – the on-line reservation tool embedded in the Website, integrated with WooCommerce.

  • “Agreement” – these T&C, the booking confirmation, any special written conditions and the signed charter contract.

2. ACCEPTANCE OF THE TERMS

2.1 By ticking the box during an online booking, paying any deposit/balance, or signing the charter contract, the Charterer accepts this Agreement on behalf of all guests.
2.2 If any provision is held invalid or unenforceable, the remaining provisions continue in full force.

3. BOOKING PROCESS

3.1 Quotation & Availability – Quotes remain provisional until the 50 % deposit is received. Prices are in EUR and include crew, soft-drinks package, standard insurance and VAT unless stated. Fuel, Extras and moorings outside Marina Botafoch are excluded.
3.2 Deposit – Booking is confirmed only after deposit via card, bank transfer or (24–48 h notice) cash/crypto.
3.3 Balance – Remaining 50 % payable upon disembarkation on the final day unless agreed otherwise.
3.4 Documents – The Company issues:
a) booking confirmation e-mail;
b) electronic invoice/receipt;
c) charter contract to sign on/before embarkation. Guest names, ID/passport numbers and dietary/medical notes must be provided ≥48 h before departure.

4. PRICES, TAXES & FUEL

4.1 Included: captain & stewardess, towels, soft drinks & snacks, snorkel gear, standard mooring at Marina Botafoch.
4.2 Excluded:
• Fuel at cost (≈ 600 L / h, per engine-hour log)
• 21 % Spanish VAT (if applicable)
• Extras (Seabob, paddle boards, jet-ski escort, chef, premium spirits, drone, etc.)
• Moorings outside home port
• Crew gratuities (discretionary, 5–10 %)
4.3 Unless stated, all prices are exclusive of fuel and VAT.

5. SECURITY DEPOSIT

5.1 Day charters – normally no damage deposit.
5.2 Overnight charters or high-risk activities – refundable deposit up to €3,000 pre-authorised on embarkation, released ≤48 h after disembarkation minus any proven damage/loss.

6. CANCELLATION & REFUNDS

6.1 Cancellations must be e-mailed to bookings@vipyachtibiza.com.
6.2 Weather/technical cancellation (Captain’s decision): client may choose full refund or reschedule within same season, subject to availability.

7. CHECK-IN, CHECK-OUT & CHARTER HOURS

7.1 Choose any continuous 8-hour slot between 10:00 and 21:30 (latest return).
7.2 Standard schedule 10:00–18:00. A later start (e.g. 15:00) still returns by 21:30 at same price.
7.3 Overtime beyond 21:30 or early departure only by prior agreement, €600/hour, crew availability permitting.

8. CLIENT OBLIGATIONS ON BOARD

  • Follow Captain’s instructions at all times.

  • Do not exceed 12 guests by day / 8 overnight.

  • Wear life-jackets when instructed; children <12 yrs must wear them on deck.

  • No illegal drugs, weapons, fireworks. Smoking only on aft deck, windward side.

  • Pets only with prior written approval.

  • Charterer is liable for damage caused by negligence/misconduct of any guest.

9. CAPTAIN’S AUTHORITY & SAFETY

9.1 Captain has ultimate authority over navigation, safety and discipline, and may alter route, restrict water-sports or end charter early for safety, weather, port orders or guest misconduct; no refund is due in such cases.

10. WATER-TOYS & EXTRAS

10.1 Included: snorkel sets, basic inflatables.
10.2 Optional (24 h pre-booking):
– Seabob F5 S: €350/day
– 2 × paddle boards: €120/day
– Jet-ski escort: €450/day
– On-board chef (lunch): from €400 + groceries
– Premium spirits/champagne: quote on request
10.3 Use of toys at guest’s own risk; follow crew briefing.

11. LIABILITY & INSURANCE

11.1 Vessel insured under Spanish law for public liability & third-party risks up to €6 million.
11.2 Company not liable for personal belongings lost/damaged unless due to crew gross negligence.
11.3 Guests are advised to obtain personal travel, medical and cancellation insurance.

12. FORCE MAJEURE

Neither party is liable for non-performance due to events beyond reasonable control (e.g. severe weather, natural disaster, pandemic, war, strike, port closure, unforeseen mechanical failure). Obligations are suspended; prepaid sums for un-rendered services will be refunded or charter rescheduled.

13. PAYMENTS, CURRENCIES & FEES

  • All invoices in EUR.

  • Accepted: Visa, Mastercard, Amex, SEPA bank transfer, cash, Bitcoin or USDT (24–48 h notice).

  • Bank and blockchain fees are borne by the Charterer.

14. COMPLAINTS & CLAIMS

Notify the Captain immediately, then confirm in writing to info@vipyachtibiza.com within 7 days after charter end. We acknowledge within 5 working days and aim to resolve within 30 days.

15. PRIVACY

Personal data is processed in accordance with our Privacy Policy and Cookies Policy (links in footer). By booking you consent to such processing.

16. INTELLECTUAL PROPERTY

All photos, text, logos and layouts on the Website are © ARGIOD S.L. 2025. Reproduction, scraping or distribution without written permission is prohibited.

17. MODIFICATION OF TERMS

The Company may update these T&C at any time. The version displayed on the Website at the time of booking governs that booking. Continued use after changes constitutes acceptance.

18. GOVERNING LAW & JURISDICTION

This Agreement is governed by Spanish law. Any dispute is submitted to the Courts of Madrid, except where consumer-protection rules mandate another forum.
